Terms and Conditions for Heritage Livestock App

Welcome to the Heritage Livestock App! Please read these terms and conditions carefully before using our platform. Please note there are legally binding obligations if you choose to engage with the app and all sales are final, even if you accidentally bid. 

Examine horses to your satisfaction prior to bidding. All horses sold in this auction are being sold “as is, where is” by this auction company (Heritage Livestock, LLC.). ANY warranty or recommendations about your purchases is entirely between the seller and buyer. There are no warranties or representations of merchantability, of fitness, nor of any other kind express or implied. Written and oral descriptions of any lots are opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, or any feature of items being sold. Heritage Livestock, LLC., is a medium between seller and buyer and NOT an agent for either one. We provide a setting for both to meet and provide marketing efforts for a sales commission only. 

We expect our sellers to represent their horses accurately and honestly and our buyers to fulfill their obligation to pay in full by close of the auction. 

Any and all statements made from the auction block supersede printed material. 

Refusal of the final bid or “No Sale” must be declared by seller before horse leaves sale ring. Upon the horse leaving the ring all sales are final.

Heritage Livestock staff handles registration papers, applications, certificates, transfers, etc., that are turned in by the consignor and turned over to the buyer upon payment. We recommend you inspect these prior to bidding. You can ask to see them in the office.

Horses will be cared for to the best of our ability, however Heritage Livestock, LLC. will not be responsible for any sickness, injury, or death. Care, custody, and control is the buyer’s responsibility upon purchase. If you are leaving horses overnight for later pickup, please inform the office staff so arrangements can be made for the horses to be fed and watered sale night.

1. Acceptance of Terms

By accessing or using the Heritage Livestock App, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not use the app.

2. Description of Service

The Heritage Livestock App provides a platform for users to bid on horses listed for sale by sellers. The app facilitates communication and transactions between buyers and sellers. Heritage Livestock, LLC. acts as a third party and is not an agent for buyer or seller. All claims, statements, and disclaimers are strictly between buyer and seller. 

3. Bidding

3.1. Bidding Process: Users may place bids on horses listed for sale within the app. Bids are binding and cannot be retracted once placed. Every bid is binding. If you or a user on the app on your phone places reserves on multiple horses and wins the bid on one or more, then you are responsible for paying for all of the horses for which you are the high bidder. By placing a bid, either in person, by the phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you hire an expert of your own choosing examine the lot for you or do not bid on the item in question.

3.2. Winning Bid: The highest bid at the end of the bidding period will be considered the winning bid, and the bidder is legally obligated to purchase the horse at that price.

3.3. Payment: Upon winning a bid, the bidder is required to make payment for the horse immediately. Failure to do so may result in penalties or account suspension, or removal of privileges to attend any future sale both in-person and online bidding. Please note, there is a 5% Buyers Premium for all online sales. 

4. Sales

4.1. All Sales are Final: All transactions conducted through the Heritage Livestock App are final. Once a bid is accepted and payment is made, the sale is considered complete, and no refunds or exchanges will be provided.

4.2. Seller Obligations: Sellers are responsible for providing accurate descriptions of the horses listed for sale, including any relevant information about health, temperament, and history. However, nothing can replace visual appraisal and inspection of each horse on-site. Announcements from the block supercede anything written in the catalog. Pre purchase exams are encouraged and are to be done at the expense of the buyer. Post-purchase exams are not an acceptable. 

5. User Conduct

5.1. Users agree to use the app in compliance with all applicable laws and regulations.

5.2. Users must not engage in any fraudulent, deceptive, or abusive behavior on the app.

6. Dispute Resolution

6.1. Any disputes between buyers and sellers must be resolved directly between the parties involved. Heritage Livestock, LLC is not responsible for mediating disputes.

7. Modification of Terms

We reserve the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on the app. Continued use of the app after any such changes shall constitute your consent to such changes.

8. Termination

We reserve the right to suspend or terminate your access to the app at any time for any reason, without prior notice or liability.

9. Limitation of Liability

To the maximum extent permitted by law, the Heritage Livestock App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or revenue, arising out of or in connection with your use of the app.

10. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the United States of America.
